After the dissolution of the Assemblies of Punjab and Khyber Pakhtunkhwa, the country is facing a constitutional crisis due to the absence of elections within ninety days and that is why the matter is now being heard in the Supreme Court, but see our tragedy that in the same case, such a judicial crisis also raised his head which is unprecedented.
Based on the decision of the Supreme Court, President Arif Alvi had scheduled elections in Punjab on April 30 in consultation with the Election Commission. The decision was not a majority. Two days ago, a dissenting note of two judges came out in this regard, which showed the difference between the judges in the Supreme Court, which many people They are comparing it to the silence between the judges, brought to a point that has never been heard before. These judges challenged the powers of the Chief Justice of Pakistan in a way that showed no consideration and no tenderness.
They boldly said that the Chief Justice's one-man power show cannot go on, it must be ensured that the Supreme Court Do not become a royal court. It also said that the Chief Justice has unbridled power which he enjoys but the prestige of the judiciary is being eroded and he is facing severe criticism. These judges also said in their judgment that the Supreme Court has completely failed to structure the exercise of its powers. The decision also said that the Supreme Court should not interfere in provincial affairs, the Supreme Court should not undermine the independence of the High Court.
For a long time, some of the most important judges of the Supreme Court, the Chief Justice of Pakistan, have been taking suo motu, making benches and cases The powers of fixing were being questioned, but this decision has created a situation of no confidence in the Chief Justice, without any wrapping. Taking advantage of this situation, the ruling coalition came into immediate action and introduced a bill in the Parliament which aimed to institutionalize the unlimited powers of the Chief Justice of Pakistan to take suo motu action, form benches and fix cases as per the judgment of the Supreme Court judges. will go Meanwhile, government members and Prime Minister Shehbaz in the Parliament raised questions on the powers of the Supreme Court and the Chief Justice and even said why those who advise others to consult do not consult themselves.
It was also said in the media that the Chief Justice mentions the fight between the politicians, but he does not have an eye on the fight going on inside the Supreme Court. Tehreek-e-Insaf is considering this government move as an attack on the Supreme Court. I am afraid that the Chief Justice from the Parliament Legislation to limit the powers of the Supreme Court and to exercise these powers through committees of judges may be subject to a possible response from the Supreme Court. It is possible that the Chief Justice and his like-minded judges may declare such legislation of the Parliament as an attack on the independence of the judiciary and strike down any such law, which may bring the Supreme Court and the Parliament face to face and this will lead to eternal crises. It can push Pakistan into another big crisis.
It is
unfortunate for Pakistan that at a time when Pakistan needs unity, we are
suffering from division after division and new crises. Rulers,
politicians, judges and generals should understand the fragility of the current
situation and instead of pushing Pakistan into new crises, they should take
care of their own personal and political interests and their egos to get Pakistan
out of the current economic, political, administrative, constitutional and
judicial crises.
